HARARE – Ten Citizens Coalition for Change (CCC) candidates on the party list for the provincial council in Bulawayo have lost their application for review challenging the nomination court’s decision to reject their papers over late filing.
They are led by Aquilina Kavidza Pamberi, who is the lead applicant together.
The 10 filed an urgent court application accusing the Zimbabwe Electoral Commission (ZEC) of depriving them the opportunity to submit their party nomination papers.
But on Friday, Justice Bongani Ndlovu declined jurisdiction saying the application was not properly before him, hence it should be struck off the roll.
“This application is not properly before me and deserves to be struck off the roll. It is therefore ordered that the application be and is hereby struck off the roll,” ruled Justice Ndlovu.
The 10 had asked the High Court to order ZEC to allow them to submit their candidate names and reverse the election of Zanu PF provincial council candidates who stood unopposed.
ZEC argued that the opposition party had three lists for senatorial, national assembly and youth quotas but none for provincial council.
It also argued that CCC attempted to submit its provincial council party list while submitting amendments to its initial nomination papers which was prohibited.
Provincial council seats are filled using the results of the harmonised elections, taking into consideration the total number of votes collected by the lower house of assembly candidates from each political party.
