HARARE – Bindura mayor Jacob Gwature will remain in custody for three more days after his bail application was delayed at the Harare Magistrates Court on Tuesday.
Gwature, who was arrested on September 23, is charged with fraud alongside Jonathan Kapasi.
The duo appeared before Harare magistrate Marewanazvo Gofa who said ruling on their bail application will be handed down on September 29. The magistrate asked for written submissions from lawyers.
Gwature and Kapasi, through their company, are accused of failing to drill a borehole after collecting money from a customer based in the United Kingdom.
They initially appeared in court over the weekend before they were remanded in custody.
On Tuesday, the prosecution represented by Pardon Dziva told a court in Harare that they would file written submissions opposing bail.
“We make an undertaking that we will file and serve our papers by close of business tomorrow (Wednesday),” Dziva said, adding that they had agreed the timeline with the defence.
According to the state, the two through their company Pamhodzi Rainbow Network entered into a contract with a United Kingdom based company, Kitchen Table Charities Trust, in 2021.
Under the contract, Pamhodzi Rainbow Network was hired to drill a borehole and install a solar system to power the borehole at stand number 1305 in Budiriro 1, Harare.
The prosecution however alleges that the two men and their company failed to deliver the services despite being paid £5,000, which is equivalent to US$6,970.
